New York Real Estate Law states that all Real Estate Agents work for the seller even if the home is not the agent’s listing. Sellers are given fiduciary duties and buyers are given fair and honest treatment.


If you do not want to be represented, then I cannot negotiate to get you the lowest price possible. I can’t do anything that could hurt the seller getting the highest price possible.


As your Buyer Representative I will owe you fiduciary duties and fair and honest treatment to the sellers. I also can do the following for you:

Negotiate on your behalf to get you the lowest price possible.

Pull comparable homes to make sure you are getting a good deal and are not overpaying.

Tell you how long the home has been on the market.

·      
Tell you how many price reductions the home has had.

·      
Tell you how many times the home has been on the market.

·      
If and when I find out any “secrets” the seller may have, I can tell you. For example, if the listing agent tells me their seller is desperate to move, I can tell you that.


If you walk into an Open House and the selling agent tells you that you do not need representation that is not true. Yes, you can purchase the home through them but you will not get fiduciary duties because that agent works for the seller.
